CORPORATE AND LABOUR LAW

The activities of our law firm particularly regard the assistance and consultancy for the management and resolution of problems regarding relations with employees, managers and administrators, the study and compilation of restraint of trade clauses, contracts for collaborators and other forms of flexible agreements that are used as an alternative to regular paid employment contracts. The activities also include consultancy to the human resources managers of our client companies, even for any everyday problems that may arise, with particular reference to work and services contracts, enforcement of disciplinary sanctions, dismissal of employees, the consensual resolution of work contracts, transfer and changes in role, assistance in head offices (Provincial Directorate of Labour) as well as in a juridical and trade union setting. Another problem of increasing importance, for the implications connected to the privacy laws, is the remote surveillance of employees (e.g. using video surveillance, monitoring internet activity, controlling electronic mail etc.).

RESPONSIBILITY IN THE MEDICAL AND HEALTH SECTOR

Research, training and legal consultancy for hospitals, National Health Service, care homes, pharmaceutical companies, universities, Ministry of Health and relative institutions, Territorial Public Institutions, European Commissions, foundations, medical practitioners associations, medical associations, insurance companies, companies operating in the health sector, and jurisdiction for sick persons, etc.
Assistance with the individualisation and analysis of those departments most at risk, compilation of forms (e.g. information provided to patients, consensus to health treatment, etc.), individualisation of guide lines (e.g. compilation of medical records) etc.
Participation and legal advice at risk management committees in health structures, at Ethics Committees etc.
Definition of out-of-court settlement of disputes (e.g. Arbitration Chambers or Conciliation Chambers).
Activities with regard to the nomination of a supportive administrator, for example the treatment consensus of a patient that is only partially capable of making decisions.
